Anti Piracy letter - COMPASS

Filed under: Mailers — info @ 1:41 am

15 February 2010

Dear Members,

As you all know that we had a very good interactive seminar on Intellectual Properties Rights by Dr. Dewan. The major concern of all was how to fight the menace of piracy. In response Dr. Dewan has sent his suggestions which are as below:

Suggested measures that can be taken to promote Anti Piracy drive from your organisation:

1.      In the Employment Agreement between the firm/ company and the sales person there can be a clause by way of which:

a.       The Sales Person undertakes to not provide any Software to the customer which he is not authorized by the company to give and in the event that he does it he who shall bear the liability for any action which might arise due to such an act.

b.      The sales person will indemnify the company against any loss/ damage which the company may incur as a direct or indirect result of any act done in contravention of this agreement by the Sales Person.

2.       If the agreement has already been entered into these clauses can be added as an amendment to the agreement.

3.      An undertaking in writing stating these clauses.

4.      The bill given to the customer and where he signs may state that “I accept safe delivery of the computer and accept the terms and conditions contained herein” at the back of the bill you may write the terms and conditions which may state

a.       the computer has been delivered safely to me

b.      the computer is in good working order

c.       the computer does not contain any unlicensed or pirated software

d.      I state that the Company has not installed on this computer delivered any pirated or unlicensed software.

e.       The only software contained in this computed is ______ and no other.

f.       I have accepted the abovementioned conditions and taken delivery only after verifying the above. I will not hold the company liable for any pirated software found on this computer after its delivery to me and I shall indemnify the company if it suffers any loss / damage due to any infringement action being initiated as a result of any pirated/ infringing material being found on this computer.

5.      The Office may have an anti piracy policy framed and put in a conspicuous place in the office.

Thanking You,

Alok Garodia

Press release- Microsoft and channels resolve differences to make a new beginning

Filed under: Mailers — info @ 2:16 am

Press Release

Microsoft and channels resolve differences to make a new beginning

Kolkata , India - 19 December 2009 :  Microsoft and other nodal bodies for IT Channel partners of Eastern India led by COMPASS have deliberated and agreed on new engagement practices between Microsoft and the Channel to improve business relationships and to combat piracy jointly. Earlier the channel and Microsoft had developed some differences in this area.

Mr. Alok Garodia, President - COMPASS on behalf of all the IT Associations of Eastern India said :

“ We are glad to state that Microsoft and the channel has resolved all our differences and we have agreed to work together to ensure growth of business for the channel and Microsoft.  We are totally against software piracy since it is a huge loss of revenue for the channel. The cost to the channel is significant. In October IDC produced its annual study on the economic impact of IT, software and the Microsoft ecosystem, illustrating why software piracy is a big concern for Microsoft and the channel at large. The study covered the 52 countries that account for 98 percent — $1.414 trillion — of total IT Spending in 2009, and packaged software represents 21 percent of that number. Nearly 700,000 hardware, software, services, and channel firms make up the Microsoft ecosystem in these countries and for every unit of revenue – dollar, euro, peso, etc. – that Microsoft will earn in 2009, other companies will earn 8.70. We are thankful to Microsoft for understanding the pain points of the channel and  agreeing to work together in resolving the issues. We expect to make a new beginning with Microsoft and we are confident that the New Year will usher in a new phase of growth for the channel and Microsoft in India . ”

“We are extremely satisfied that the IT Associations of the East approached Microsoft with their areas of concern in the channel and for giving us an opportunity to address the problems and take pro-active measures. Our recent engagement with the IT Associations has been meaningful and result oriented with a prime focus on working jointly to address the issues of business as well as piracy. The key aspect of this understanding and the joint resolution is its long term vision on relationship and partnership to check piracy in the region and to promote the value of genuine software in the interests of the consumers and the  reseller community. Microsoft is confident that its relationship with the IT Associations of the East will only grow and cemented further, which will enable the channel and Microsoft to mutually collaborate on an on-going basis to contribute towards the overall development of the IT Eco-System of the country.” Said Mr. Vipul Sant, Director - Genuine Software Initiative and Keshav S Dhakad, Director – IPR & License Compliance, from Microsoft.

Cancellation of Compass 2009 Exhibition !

Filed under: Mailers — info @ 6:20 am

Dear Members,

Thanks for your support for booking of stall for Compass 2009, which was scheduled to be held on 11th to 13th April. I appreciate your affection towards Compass.Inspite of negative growth of IT Industries and less support from Vendors and OEM our members, once again has shown their strength to commit their booking and enable it to reach our desired stall booking. I really salute the spirit of which has been shown by our members towards their association.

But Suddenly, We came to know that IPL Match will be held on 11th April At Eden Garden near our venue. We have contacted with various authorities and they refused to commit any solution or any positive assurance from their side. Whether, we should go for the Show or cancel it.

As you are also aware, The General Election is also declared. Our venue NIS is under Govt. Of West Bengal, they could have also right to cancel the show, if they need for any Election activity.

After considering all the Fact, and uncertaintity to get the venue. The president called an Emergency Committee Meeting On 21st March “09” and finally your Committee took a hard decision to cancel the show to avoid unnecessary hurdle and and Financial Losses.

We are extremely sorry for inconvenience caused to you.

Thanking you once again for your overwhelming support.

Looking forward for your valuable support in future to make Compass more and stronger.

Thanking You

With Warm Regards,
